When people decide to pursue a divorce in California, there are many different issues that must be resolved before a court will legally dissolve a marriage.  One of those issues involves the division of property that's contained in the marital estate.  This can be a complicated process under California's community property laws, and one potentially complicated asset is a life insurance policy.  There are several different ways that this policy or these policies can be handled such that problems should not arise in the future.

Specifically, the complications that tend to arise in community property states such as California involve whole life policies that have an actual value.  When dividing the state, an examination of a life insurance policy will need to be done to determine whether or not the policy was purchased prior to marriage or if it was paid by one party if it was purchased after the marriage.  As is the case with other assets, life insurance policies purchased before marriage and paid by one party would likely not be included in the marital estate depending on the specifics of the situation.

In addition, questions arise regarding what type of life insurance coverage would be advisable after a divorce is complete, particularly if there are children involved.  It is generally wise for someone who is receiving child support to have life insurance coverage on the person paying that support in case something occurred, and parents in general can set up policies to protect their children until they reach the age of majority.
