As the years continue to pass and domestic violence remains an enormous problem for society despite all of the noble efforts of so many different governmental agencies, non-profit groups and courageous individuals, more steps are being taken in an attempt to deter this type of conduct.  As such, the State of California is once again adding to its statutory language regarding domestic violence.

Beginning on January 1 of 2012, the conditions that can lead to a charge of domestic violence being charged as a felony will expand to include any situations where the victim suffers an injury because of strangulation or suffocation.  Therefore, any sign that this type of an injury was inflicted can lead to much more serious charges for the alleged abuser.  This statute has expanded more than once in the past to include specific acts and types of harm to make it easier for prosecutors to bring more serious charges.

As it stands now, people who are accused of domestic abuse can be charged either with a misdemeanor or with a felony, and some of these situations will be left up to the discretion of the local district attorney’s office.  However, as more specific language is added to these different statutes, the less wiggle room that will be present and the more direct prosecutions will become.
