The world has changed dramatically in recent years with the advancement of forms of technology that until recently were beyond the wildest dreams of the average person.  While this technological advancement has made life easier for countless people and in countless ways, technology is also affecting situations that include litigated divorce cases.  According to a recent survey of divorce lawyers, smart phones in particular are becoming more relevant in these situations.

The survey, which asked questions of family lawyers who belong to the American Academy of Matrimonial Lawyers, or the AAML, revealed that the majority of the group’s members have seen a sharp rise in the number of cases involving evidence that’s taken from smart phones and text messages.  Specifically, nearly two-thirds of the evidence derived from smart phones involves text messages that are used for some reason.  Emails and call histories are also used, although not as often according to the attorneys participating in the survey.

What this means in general is that the more we depend on our technology, the more we tend to leave footprints regarding what we are doing, who we are communicating with and most importantly in this sense who can see what we have been doing.  Smart phones, many say, know more about us than we do, and this type of evidence will likely only become more common in the future as spouses litigate their divorce cases.
